High Road Tours, LLC – Waiver & Policies

*****PLEASE READ CAREFULLY—THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS*****

In consideration of being permitted to participate in any tour or experience offered by High Road Tours, LLC (collectively referred to as the “Company,” “we,” or “us”), located in St. Augustine, Florida, I, on behalf of myself, my heirs, executors, administrators, and assigns, agree as follows:

Assumption of Risk: I understand that participation in walking tours and related activities involves inherent risks that cannot be eliminated. These risks include, but are not limited to:

• Slips, trips, and falls on uneven, cracked, or historic sidewalks and streets
• Injuries from weather conditions (heat, rain, humidity, lightning)
• Insect bites, allergic reactions, or sun exposure
• Interaction with traffic, bicycles, or other pedestrians
• Physical fatigue or exacerbation of pre-existing medical conditions
• Any risks associated with nighttime or low-light tours

I voluntarily assume all risks, known and unknown, and agree that I am physically fit and able to participate. I confirm I have no medical conditions that would make participation dangerous.

Release and Waiver of Liability:I hereby release, discharge, and covenant not to sue High Road Tours, LLC, its owners, guides, employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation, including those caused by negligence of the Company or its representatives.

This release includes, without limitation, any injury, death, or property damage I may suffer.

Indemnification: I agree to indemnify and hold harmless the Company from any loss, liability, damage, or cost (including attorney’s fees) that may arise from my participation or any breach of this agreement.

Minors: If I am registering a minor (under 18), I am the parent or legal guardian and agree to the above on the minor's behalf.

St. Augustine, Florida is known for its beautiful but unpredictable subtropical weather. Afternoon thunderstorms, sudden heavy rain, and high humidity are common, especially during the summer months.

• We do our best to run every scheduled tour as planned, even in light rain, because many guests still wish to experience the tour.
• Our guides are experienced and will make real-time decisions based on safety. Light to moderate rain will usually not cancel a tour.
• In the event of severe weather (lightning, tropical storms, flooding, or dangerous conditions), we may delay, shorten, modify the route, or cancel the tour for your safety.
• If we cancel the tour due to severe weather, you will be offered a full refund or the option to reschedule at no additional charge.
• No refunds will be issued for tours that proceed in light rain or if you choose not to attend due to weather.
• We strongly recommend you dress appropriately (water-resistant shoes, a rain jacket, and a hat) and bring a small umbrella. Tours are rain or shine unless safety requires otherwise.

By booking, you acknowledge that weather is unpredictable in Florida, and you accept the possibility of participating in light rain.

Booking and Payment

• All bookings are subject to availability.
• Full payment is required at the time of booking.

Cancellation & Refund Policy

• Cancellations made more than 48 hours before the scheduled tour: Full refund minus any processing fees.
• Cancellations made within 48 hours: No refund.
• No-shows: No refund.
• Weather-related cancellations follow the Florida Weather Policy above.

Health and Safety

• Participants must wear comfortable, closed-toe walking shoes.
• We recommend bringing water, sunscreen, and insect repellent.
• Tours involve approximately 1–2 miles of walking.
• Participants are responsible for their own personal belongings.

Photography & Media Release: By participating, you grant High Road Tours, LLC permission to take and use photographs and video of you for promotional purposes. You may opt out by notifying us in writing before the tour.

Code of Conduct: We expect respectful behavior toward guides and other participants. Disruptive, unsafe, or disrespectful conduct may result in removal from the tour without refund.

Limitation of Liability: To the fullest extent permitted by law, High Road Tours, LLC’s total liability shall not exceed the amount paid for the tour.

Governing Law: This agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of St. Johns County, Florida.

By booking a tour with High Road Tours, LLC, you acknowledge that you have read, understood, and agree to this entire Waiver & Policies document, including the Florida Weather Policy.
